As a member of SAEA, your rights are protected by the collective bargaining agreement between SAEA and the Santa Ana Unified School District. You'll find Grievance procedures are set out in Article VI.

Areas of frequent concern to teachers include:

When you feel your rights under the Contract have been violated, you should contact an SAEA Rep to accompany you to a meeting with the principal. If you do not have a satisfactory resolution to your concern, you should inform the principal that the meeting is an oral grievance and contact SAEA as soon as possible.

On the other hand, if your administrator asks for a meeting, you have the right to a reasonable amount of time to get a rep to accompany you. Do not be insubordinate by refusing to meet. Listen and take notes. If pressed on an issue regarding potential legal problems, say "I will be happy to respond after talking to SAEA." Only the CTA Staff are authorized to get you a CTA attorney, and ordinarily this is reserved for specific issues regarding serious charges.

SAEA's Legal Responsibilities

  • Exclusive representative of: certificated teachers, speech/language pathologists, nurses, librarians, psychologists;
  • Duty to enforce the Collective Bargaining Agreement;
  • Representative for members in meetings with District administrators when such meetings might lead to discipline;
  • Represents members when District violates the Educational Employment Relations Act (EERA) by filing an unfair labor practice charge with the Public Employment Relations Board (PERB).

.: Your Role as the Grievant

  1. Be informed. Refer to the Article(s) being grieved in your contract. You will receive a pink copy of your grievance form within 10 days after the oral conference.
  2. Let your rep do the talking. Your SAEA rep has been trained and has an established relationship with District administrators. Let your rep speak on your behalf.
  3. Be prepared. Bring organized documentation to clarify your grievance.
  4. Be flexible. An offered solution may or may not be your first choice. Your SAEA rep will meet with you privately to determine if the resolution is acceptable. There will always be pros and cons to any resolution.
